Our lawyers working in Debt Recovery and International Debt Recovery have considerable experience in debtors rights and remedies, all debt recovery remedies under the Rules of Civil Procedure, creditors rights and remedies, including freezing orders, orders of attachment, Mareva injunctions, orders obtained, without notice, to obtain disclosure of documents, including bank statements (by the so-called Norwich order) and for the urgent preservation of property (including high value personal property, machinery and equipment), evidence and documents.

We have also acted in the recognition and enforcement of judgments and injunctions obtained in  the US and other jurisdiction.

We are regularly consulted and retained in relation to cross-border litigation. This may involving bringing suit, or responding to suit in this jurisdiction, against defendants located here and elsewhere.  We are experienced in the Toronto-based Commercial List, which may hear matters concerning the enforcement of international arbitration awards.

We have considerable experience bringing and responding to challenges to jurisdiction and forum.

When foreign lawyers require evidence of a witness located in this jurisdiction, we are often retained to seek local recognition and enforcement of letters rogatory, letters of request or orders for foreign judicial assistance, or commission evidence. We can provide prompt assistance, including guidance to foreign lawyers on what orders are likely to be recognized here, the ambit and scope of documentary and other evidence that likely will be ordered, and the related structure of their local request for foreign judicial assistance.
