Domestic and, US and Other Foreign Debt, Judgments and Awards

We are often consulted or retained in connection with recovery of large local debt or foreign debt, including casino debt, or to seek recognition  and enforcement in Ontario, Canada, of judgments, orders, or arbitration awards obtained in Ontario, other provinces of Canada, US and other foreign jurisdictions.

We are sometimes retained to work with the assistance of lawyers practicing debt recovery in other jurisdictions, including, those located offshore.

Claims on Loan Guarantee

We can advise and represent those claiming payment on a guarantee, and those named as guarantor of a loan.

Loan or Gift? | Loan or Investment?

Disputes sometimes arise when either a payment advanced or transfer is alleged to be a loan rather than a gift, or alleged to a loan rather than an investment, or vice-versa.

We have relevant experience in both domestic and cross-border litigation.

Injunctions and Other Urgent Relief | Enforcement of Foreign Injunctions and Orders

Our lawyers working in Debt Recovery and International Debt Recovery have considerable experience in debtors rights and remedies, all debt recovery remedies under the Rules of Civil Procedure, creditors rights and remedies, including freezing orders, orders of attachment, Mareva injunctions, orders obtained, without notice, to obtain disclosure of documents, including bank statements (by the so-called Norwich order) and for the urgent preservation of property (including high value personal property, machinery and equipment), evidence and documents.

We have also acted in the recognition and enforcement of judgments and injunctions obtained in  the US and other jurisdiction.

Cross-Border Litigation   | International Arbitration | International Judicial Assistance

We are regularly consulted and retained in relation to cross-border litigation. This may involving bringing suit, or responding to suit in this jurisdiction, against defendants located here and elsewhere.  We are experienced in the Toronto-based Commercial List, which may hear matters concerning the enforcement of international arbitration awards.

We have considerable experience bringing and responding to challenges to jurisdiction and forum.

Letters Rogatory | Letters of Request | International Judicial Assistance

When foreign lawyers require evidence of a witness located in this jurisdiction, we are often retained to seek local recognition and enforcement of letters rogatory, letters of request or orders for foreign judicial assistance, or commission evidence. We can provide prompt assistance, including guidance to foreign lawyers on what orders are likely to be recognized here, the ambit and scope of documentary and other evidence that likely will be ordered, and the related structure of their local request for foreign judicial assistance.
